If the house is listed on the MLS as a "courtesy" of a certain realty company, do I have to use that company or can I go to the realtor of my choice in that area?  more

Resolved Question: Buying a house, have given earnest check that has not been cashed yet?

I am in the process of buying a house. It is a foreclosure and a realty company is representing Fannie Mae and has it listed. "As Is" During the first contract the house inspection was put off once for a quality control check of the records. I re-scheduled my inspector, then I paid $125.00 to have the water turned on (that was part of the deal as the house was winterized, and was to be re-winterized following inspection) The house was scheduled to be inspected on the 14th of February. Then at 3:30 p,m, on Friday the 13th I get a call that the water was turned on a quickly shut off due to a water leak that was caused by freezing weather because they winterized late (They needed to have legal access to the house before going in to winterize and there was freezing weather before they could do so) At this point in order to proceed I had to cancel the contract as I had till 5 p.m. or I would stand the chance of loseing my earnest money. I also had to call off my house inspector again. I went back to the house with my realtor that following Monday only to find out that it was a minor elbow on a basement pipe that had froze that was adjacent to an exterior wall, really no big deal. On Tuesday I resubmitted my original offer and asked that it simply (the leak) be repaired and the I had to start the process all over. In the maentime the listing agent knew I was re-submitting my offer due to a misunderstanding as to what the damage was as they gave me only an hour and a half to make a decision while I was at work and could not leave before 5 p.m. to go out and look at it. I resubmitted my original offer, only to find that he relisted the house on MLS, lowered the price by $7,100 dollars and put flyers in the box reflecting such a price the very same day he got my resubmitted offer, with the same MLS listing number. They still have my earnest money check and I have been told my offer was sent to Fannie Mae again and is in process. I expected an answer by Friday, but was told it would maybe come Monday. My wife and I really want this house and are all approved and ready to still close on the 12th of March as was the original date to close and the listing agent says that when we pulled out it put him in a bad situation, I say it has been them doing so. What are the thoughts out there?  more

What option should I use when selling FSBO? I dont want to lose 7% to a realtor when I am 100% confident that I can do the work my self. Should I use a giant sign in my yard, 2.5% direct, americas choice or a flat rate mls number? Is there a way to bird dog realtors for a sale? I wouldnt mind paying a couple grand but 7% would just kill me. Comps are selling for $180 - 190,000. I was going to buy a url and make a website that has a couple hundred pictures and a video walkthrough. I am savvy with advertising but I want to be open to realtors as well without locking into one to sell it for me and paying 7%. Please help. I would have no problem paying 3% to a realtor to sell my house. I just dont want to pay 6 ot 7 %. Am I correct is saying that if I have a mls number for my house I wouldnt have to pay commission for a selling realtor b/c it is me and all I would have to pay is 3% to a realtor if they bring in a client and sell my house? I also have a great lawyer to use for closing. I know that it is taking a while for houses to sell. luckly I live in a very nice area and houses are selling in about 2 months. I was thinking about putting up a huge sign that says: "for sale by owner" then my website address and "by appointment only". My biggest concern is that I want realtors to be able to show and sell my house without paying them 6 - 7% in commission.  more

Voting Question: House says active contingency but also has sold sign posted?

I've been looking to buy a particular house that had been a status of active, although when I called 2 weeks ago the agent said it was under contract. I've been checking the status everyday on various realty websites and yesterday the status changed from active to active contingent. However, I drove by the actual house yesterday and they had just put up a "sold" sign. My question is why would the staus change in the mls to active contingent AND a "sold " sign put up on the actual sign in the yard on the same day? Is this still worth pursuing or should I just consider it sold? Would a sold sign be put up before the actual closing? Any insight would be appreciated! Thankyou  more

Resolved Question: I have a question about a flat rate MLS listing service I'm using in Texas.?

I'm using a flat rate MLS listing service that I found online. It is a good rate $200 and my listing is showing up beautifully on Realtor.com (with 8 pics and virtual tour), Yahoo Real Estate, Zip Realty etc. I am very happy with the price, speed, and accuracy of what this agent has done. My question is about the TAR Listing Agreement. Our arrangement is for her to have a flat rate of $200 and if she does end up bringing me a buyer then she'd receive 3%. She filled out the contract to say in section 5 (broker's fee) 3%. Then in section 8 (cooperation with other brokers) she has 3% listed in each of these fields. Did she fill this form out properly per our agreement or is she arranging for 6% somehow. I don't have any reason to doubt her, just not familiar with this form. Ok, the first question I asked was a little ambiguous. I know I can get a title search done, that is NOT the question. The question is HOW, or even better, what are the STEPS involved in the process. I know we start at the courthouse real estate division and I even know where it is, but what I'd like to know is what are the locations of ALL LIENS (including IRS liens and mechanics liens) on a property. Is there a central repository? We took a class of our Prudential agents there when I was a new agent, but it went by so quickly, I think I missed parts. I frequently represent buyers in MLS and FSBO-listed properties, but I've also represented some on the courthouse steps and I want to be armed with the liens before we bid. Resolved Question: realty agency discriminates against discount brokers, legal action?

A local realestate agency does not list any MLS listing on her site the PRMOTES ALL MLS listings that are listed by dicount brokerages. She is by far the biggest agency in my area, accounting for nearly half of all home sale listings. Some refer to it as a monopoly. Since she promotes that her search engine on her site pulls up all MLS listings, could some one not seek a liability case? I know it is against the law for realtors to intentionally bypass FSBO listings, or dicounted brokerage listings. What is amazing is 95% of these sellers she bypasses in her system ARE OFFERING 3% to a selling agent. The other few are offering 2.5%. I'm one of those excluded, despite being in the MLS and offering a commission. I had my brother call her agency about my home, they told him "it is not something you would be interested in, trust me!" They have never even seen it! Do I have a case?  more
